References to “Fiscalisations.com”, “we”, “us” or “our” refer to the operator above.

By using the Website or submitting information through it, you agree to these Terms and Conditions to the extent relevant to your use of the Website.

1. Purpose of the Website

Fiscalisations.com provides independent research, analysis and reference materials relating to subjects including fiscalisation, VAT monitoring, digital taxation, receipts, regulatory requirements, technology and related subjects.

The Website may also host research studies, surveys, questionnaires, experiments, user studies and other research activities.

Website content is provided for research, informational and professional-reference purposes.

Unless expressly agreed otherwise in a separate written engagement, information available on the Website does not constitute legal, tax, accounting, financial or other regulated professional advice and should not be relied upon as a substitute for advice concerning a user’s particular circumstances.

2. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information submitted through enquiry, research, survey or contribution forms may be collected, stored and processed for the purposes described in that Policy and, where relevant, in project-specific participant information.

Research activities may use first-party browser storage or other technologies required for research-session continuity, functionality or measurement, as described in the Privacy Policy or applicable participant information.

Research-participation data is not used for advertising or direct marketing unless participants are expressly informed otherwise and any legally required consent has been obtained.

3. Website enquiries

Users may contact Fiscalisations.com through general, research, support, framework or other enquiry forms.

Submitting an enquiry does not oblige Fiscalisations.com to:

  • accept a project;
  • enter into a contract;
  • provide a quotation;
  • establish a commercial relationship; or
  • respond within a particular period.

Information supplied through an enquiry must be accurate to the best of the sender’s knowledge.

Users should not submit sensitive personal information, confidential third-party information or material they are not authorised to disclose unless it is reasonably necessary for the enquiry and they are authorised to provide it.

4. Research, surveys and participant activities

Fiscalisations.com may conduct research studies, surveys, questionnaires, experiments, usability studies, behavioural research, user studies or other research activities.

Participation in public research activities is voluntary unless expressly stated otherwise in connection with a separately agreed professional engagement.

Eligibility requirements, including any minimum age requirement, may vary between research projects and will be stated in the applicable participant information.

Research activities may record or calculate information including:

  • questionnaire and task responses;
  • response accuracy;
  • response and completion times;
  • search and selection behaviour;
  • interaction patterns;
  • task-navigation behaviour;
  • content-viewing behaviour;
  • confidence responses;
  • device or browser characteristics relevant to the research; and
  • other measurements described in the applicable participant information.

Participants may stop participating in a voluntary research activity by leaving the research unless a different process is expressly stated.

Participants must not intentionally:

  • automate responses;
  • submit fabricated or deliberately misleading participation data;
  • interfere with research timing or measurement mechanisms;
  • manipulate allocation or randomisation mechanisms;
  • attempt to access another participant’s research session;
  • circumvent research controls;
  • submit multiple responses where the research rules prohibit this;
  • manipulate eligibility or incentive mechanisms; or
  • otherwise compromise the integrity of the research.

Fiscalisations.com may exclude, invalidate or remove research data reasonably identified as automated, duplicated contrary to research rules, manipulated, corrupted, fraudulent or otherwise unsuitable for legitimate research analysis.

5. Research results and participant reports

A research activity may generate individual results, participant feedback, reports or other outputs derived from a participant’s interaction with the research.

These may include:

  • timings;
  • accuracy measures;
  • comparative measures;
  • confidence measures;
  • scores;
  • percentiles;
  • behavioural measurements;
  • summaries; or
  • other research metrics.

Unless expressly stated otherwise, individual research results are provided for research and informational purposes only.

They must not be interpreted as medical, psychological, employment, educational, diagnostic, financial or other regulated professional assessments.

A result represents only the measurements and methodology of the relevant research activity and should not be interpreted more broadly than the research design permits.

Availability of a particular result, report, downloadable file or feedback format may depend on the applicable research configuration and rules displayed to the participant.

6. Research incentives and participant benefits

A research activity may include an incentive, prize, rebate-style benefit, report, downloadable resource, random allocation, lottery-style mechanism or another participant benefit.

Where such a feature is offered, the applicable eligibility criteria and material rules will be displayed as part of the relevant research activity or associated participant information.

Participation in a research project does not create an entitlement to an incentive or benefit unless the applicable criteria have been satisfied.

Fiscalisations.com may invalidate an incentive outcome where participation has been:

  • automated;
  • manipulated;
  • duplicated contrary to the applicable research rules;
  • based on materially false eligibility information;
  • technically corrupted; or
  • otherwise conducted in a manner that compromises the integrity of the research or incentive process.

Nothing in this section excludes any right or remedy that cannot lawfully be excluded.

7. Research commissioning, sponsorship and support

Research may be:

  • independently conducted by Fiscalisations.com;
  • commissioned by another organisation;
  • supported or sponsored by another organisation;
  • promoted through outreach partners; or
  • distributed with the assistance of third parties.

Where another organisation has a material role in a research project, that role may be described in the relevant research information.

An organisation does not acquire ownership of participant-level research data merely because it commissions, sponsors, supports or distributes a research project.

Unless participants are expressly informed otherwise, research supporters, sponsors and outreach partners do not receive participant identities or participant-level identifiable research records.

Sponsorship, support or commissioning does not by itself mean that another organisation controls Fiscalisations.com research methodology, participant data or editorial conclusions.

Specific contractual arrangements for commissioned research may impose additional requirements that will be communicated where relevant.

8. Research integrity and use of results

Fiscalisations.com may analyse, validate, compare and publish research findings in accordance with the applicable research design and Privacy Policy.

Research datasets may undergo quality-control procedures, including exclusion of responses reasonably considered incomplete, invalid, manipulated, automated or inconsistent with the applicable research methodology.

Aggregated or anonymised research findings may be used in:

  • public research reports;
  • commercial research reports;
  • academic or professional publications;
  • presentations;
  • professional briefings;
  • comparative analysis;
  • subsequent related research; or
  • other research and analytical outputs.

Unless expressly agreed otherwise, participation in a research activity does not provide a participant with ownership of the research methodology, aggregate dataset, analysis or resulting research publication.

9. Contributions, corrections and submitted material

Users may submit proposed terminology, definitions, corrections, reference sources, comments or other contributions for consideration.

By submitting non-confidential contribution material, the contributor grants Fiscalisations.com a non-exclusive, worldwide, royalty-free permission to:

  • review;
  • edit;
  • adapt;
  • incorporate;
  • reproduce;
  • cite; and
  • publish

the submitted material as part of the GFTR, research, reference materials, publications or related Fiscalisations.com content.

The contributor retains ownership of any rights they hold in their original contribution.

The contributor confirms that they are entitled to submit the material and that its authorised use under these Terms does not knowingly infringe another person’s intellectual-property rights.

Personal contact information submitted with a contribution is governed by the Privacy Policy and will not be published as part of the contribution unless separately agreed.

Fiscalisations.com is not obliged to accept, publish or retain a submitted contribution.

10. Publications and downloadable materials

Fiscalisations.com may make research reports, reference materials, publications or other files available free of charge or for a fee.

Unless different licence terms are expressly stated, access to or purchase of a publication grants a limited, non-exclusive and non-transferable right to use it for the recipient’s own personal or internal organisational purposes.

Copyright and other intellectual-property rights remain with Fiscalisations.com or the identified rights holder.

A publication or downloadable work may not, without permission or another applicable legal right, be:

  • resold;
  • republished;
  • uploaded to a public repository;
  • systematically redistributed;
  • sublicensed;
  • presented as another person’s work; or
  • commercially reproduced.

Reasonable quotation, citation and other use permitted by applicable copyright law remain unaffected.

11. Paid publications and services

Where a publication, licence, commissioned research service, workshop, briefing or other offering is subject to a fee, the applicable price, currency and material transaction terms will be displayed or communicated before a binding purchase is completed.

Submitting a request for quotation, purchase request, research enquiry or project enquiry does not by itself create an obligation on Fiscalisations.com to supply the requested product or service.

For transactions requiring individual quotation, negotiation, invoicing, licence acceptance or approval, a binding contract is formed only when the applicable offer or agreement has been accepted.

Specific commercial terms agreed for a particular engagement prevail over these general Terms to the extent of any inconsistency.

12. Payments

Where online payment is offered, transactions may be processed by a third-party payment provider.

The payment provider may process payment details under its own terms and privacy policy.

Fiscalisations.com does not intend to store full payment-card credentials on its own Website where payment processing is provided directly by an authorised third-party payment processor.

13. Refunds and statutory rights

Refunds, replacements, cancellations and other remedies will be provided where required by applicable law and by any specific terms governing the relevant transaction.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may arise under the Australian Consumer Law.

14. Intellectual property

Unless otherwise stated, the Website and its original content are owned by or licensed to Fiscalisations.com.

This includes, where applicable:

  • Website text;
  • original graphics;
  • branding;
  • research methodologies;
  • survey and questionnaire design;
  • research task design;
  • experimental materials;
  • research stimuli;
  • original images created for research;
  • databases and data structures;
  • reports;
  • publications;
  • downloadable materials;
  • software; and
  • original analytical outputs.

Accessing the Website, completing a survey or participating in research does not transfer ownership of intellectual-property rights to the user or participant.

15. Citation and reference use

Public research findings and publications may be cited for legitimate academic, professional or informational purposes provided that the source and authorship are appropriately acknowledged.

Citation does not create a right to reproduce a substantial part of protected material beyond the extent permitted by law or an applicable licence.

16. Prohibited use

Users must not use the Website to:

  • violate applicable law;
  • interfere with Website security or functionality;
  • gain unauthorised access to systems, accounts or data;
  • introduce malware or malicious code;
  • scrape, harvest or systematically extract protected Website or research content without authorisation;
  • circumvent access controls;
  • manipulate research participation or research results;
  • impersonate another person;
  • misrepresent authority to act for an organisation;
  • infringe intellectual-property, confidentiality or privacy rights; or
  • materially disrupt legitimate Website or research operations.

Fiscalisations.com may restrict access where reasonably necessary to protect the Website, research integrity, users or legal rights.

17. External websites and third-party services

The Website may contain links to external websites or use third-party services.

External websites operate independently and are subject to their own terms, content and privacy practices.

A link does not imply sponsorship, endorsement, partnership or approval unless expressly stated.

Fiscalisations.com is not responsible for the independent content or practices of third-party websites.

18. Accuracy and regulatory change

We take reasonable care in preparing research and informational material.

Fiscalisation, taxation, regulatory, technology and other requirements may change after material is published.

A publication normally reflects the sources, scope, jurisdiction and effective period stated in that publication.

Research findings reflect the methodology, participant population, data and limitations of the applicable research project.

Users are responsible for determining whether information remains current and appropriate for their particular circumstances.

Corrections or updates may be made when errors or material changes are identified.

19. Website and research availability

We may maintain, modify, suspend or discontinue Website or research functionality where reasonably necessary.

We do not guarantee that the Website, a particular research activity, research session or downloadable resource will be continuously available or free from technical interruption.

Research activities may be modified, suspended or closed because of:

  • technical problems;
  • research-design requirements;
  • data-quality concerns;
  • security incidents;
  • insufficient participation;
  • project completion; or
  • other legitimate operational or research reasons.

Where reasonably possible, we will take appropriate steps to protect legitimate user and participant interests when material changes are made.

20. Limitation of liability

Nothing in these Terms excludes or limits liability, rights, guarantees or remedies where exclusion or limitation is prohibited by applicable law.

Subject to those mandatory rights, Fiscalisations.com is not responsible for indirect or consequential loss arising solely from reliance on general research or informational Website content that was not supplied under a separate professional-services agreement for the user’s specific circumstances.

Research results, participant reports and comparative research metrics are limited by the applicable research design, sample, data and methodology and must be interpreted within that context.

Any additional liability provisions applying to commissioned research, consulting, licensing or other professional services will be governed by the separate agreement applying to those services.

21. Security

Users must not attempt to test, probe, bypass or compromise the Website’s security except with prior written authorisation.

If you reasonably believe that you have identified a security or privacy issue affecting Fiscalisations.com, please report it to hello@fiscalisations.com rather than exploiting or publicly disclosing it.

22. Suspension or restriction

We may restrict or terminate access to particular Website or research functionality where reasonably necessary because of:

  • security risks;
  • unlawful activity;
  • abuse of Website functionality;
  • deliberate interference with research;
  • manipulation of participant or incentive mechanisms;
  • infringement of intellectual-property rights; or
  • other material breach of these Terms.

23. Governing law

These Terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws of Australia.

Nothing in this provision removes any mandatory protection or right that applies irrespective of this choice of law.

24. Changes to these Terms

We may update these Terms when the Website, research activities, products, services or applicable legal requirements change.

The current version and its effective date will be published on this page.

Changes do not retrospectively alter a completed transaction or separately agreed contract unless the parties agree otherwise or applicable law requires it.
